This amount is guaranteed to the principal players of the following sections: 1st Violin, 2nd Violin, Viola, Cello, Bass, Flute, Oboe, Clarinet, Bassoon, French Horn, Trumpet, Trombone, Tuba, Percussion, Timpani, Piano, and Harp. Other musicians may qualify for this stipend.

RECORDINGS

DEMONSTRATION RECORDINGS

A Demonstration Recording (herein called a Demo) is not reproduced for sale to the public. But if the Demo is reproduced and put up for sale, it becomes a Master Recording, and becomes subject to the higher scales for Master Recordings. Leaders and Contractors need to report all Demo sessions to the Union Office for clearance prior to the session. A special contract is necessary to insure that all parties understand when the Demo becomes a Master. Ask the Leader to show you the signed agreement to insure you are covered.

COMMERCIAL JINGLES

This scale is for a Master Recording that is sold to a local advertiser for use within a single marketing area. A local marketing area may be defined as approximately a 50-mile radius around a city. If the Jingle is used outside the local marketing area, it becomes a Regional Commercial Jingle, and is subject to the scale and residuals for Regional Jingles. Contact the Local office for the Regional Commercial Jingle Scale.

In addition to the session scale, the musicians who perform on Jingle sessions are entitled to re-use fees (or residuals) for Jingles that continue to be broadcast beyond a specified length of time (known as the "initial use period").

SESSION AND USE FEES

A) One hour minimum session at which up to three different commercials may be recorded. Abbreviated versions of the same jingle are not different commercials.

Example: A 15-second, 30-second, and 60-second version of the same jingle count as one commercial.

B) Sidemusician session rate is a minimum of $60.00 for the first hour, after which session overtime is in periods of 20 minutes, at a rate of $25.00 per overtime period. One additional commercial may be recorded per overtime period. Session rate includes a one-year initial use period. Leader scale is Sidemusician scale plus 50%. Contractor fee is 5% of total scale.

Examples:
1) 75 Minute Session/3 commercials recorded $85.00/Sidemusician
2) One hour session/4 commercials recorded $85.00/Sidemusician
C) After the initial use period, reuse periods are in one-year increments. The reuse fee is 100% of the wages earned on the original session.

PHONOGRAPH RECORD LIMITED PRESSING SCALE

This scale is for studio-produced Master Recordings reproduced in quantities not to exceed 5,000 units total. These reproduced units may be in any format - records, tapes, digital compact discs, etc. A major share of these sessions will be for recordings produced by a self-contained group that will promote and sell the recordings at their live performances.

If the project was financed and recorded by the group, and all proceeds from the sale of that project are to split equally, then the group is exempt from paying themselves scale.

In the event such limited pressings exceed 5,000 units, an upgrade payment to the musicians who participated in the recording will be paid based on the difference between the amount originally paid to them and the National Recording Agreement scale in effect at the time the recording exceeds 5,000 units. This scale may not be used for soundtrack albums or studio-produced symphony orchestra recordings.

A special contract should be signed by both parties and the Local notified prior to the recording session.

ON-LOCATION RECORDINGS

Many on-location recordings are produced to commemorate a particular performance by an amateur ensemble augmented by professional musicians. The following scale is applicable as an addition to live performance scale amounts due each musician.

A) Archival recording - no duplication allowed No additional fee

C) Duplication limited to less than 5,000 units Contact the Local for scale

A waiver of payment under Section B will be granted if all musicians are professionals and indicate in writing their wish for such a waiver. Signing the waiver may not be a condition of employment, however.

LOCAL PUBLIC RADIO AND TELEVISION BROADCAST (Live or Taped)

The broadcast of a performance by a local public radio or television station is subject to additional fees over and above the appropriate performance scale. Because of network affiliations, a local performance may be distributed regionally or nationally. Contact the Local for the Regional and National Scales, and to confirm on which scale applies.

MINIMUM CALL: 1 hour

ADDITIONAL COMPENSATION: $20.00/hr. per musician

LOCAL COMMERCIAL RADIO AND TELEVISION BROADCAST (Including Cable)

The broadcast of a performance by a local commercial radio or television station (including cable) is subject to additional fees over and above the appropriate performance scale. Because of network affiliations, a local performance may be distributed regionally or nationally. Contact the Local for the Regional and National Scales, and to confirm on which scale applies.

MINIMUM CALL: 1 hour

ADDITIONAL COMPENSATION: $25.00/hr. per musician
